KOSA sounds like a bill that forces platforms to protect children. It does not. At its core, the bill requires platforms to exercise “reasonable care” in how they design their products. That means documenting their process—internal reviews, design checklists, committee sign-offs. It does not require them to prevent harm. A platform that completes the paperwork is legally protected even if a child is still harmed by the result. The duty runs to the process, not to your child’s safety.

Not every bill introduced in the name of child safety delivers on that promise. Below are the #BadBills we're actively tracking that we believe expand surveillance, weaken privacy, or miss the root causes of the harms children face online.

You don't need this architecture to limit your child's social media use right now. Device-level screen time controls, app-level parental supervision tools, and a running conversation about what your child sees online are available today, with no new data collection on your family required. An engaged parent, not a government age-verification mandate, is still the most effective safeguard that exists. No compliance template, federal or state, replaces that.

Children deserve real online protections—but those protections should strengthen families, preserve privacy, and keep parents in the driver's seat. We oppose policies that require Americans to surrender more personal information in the name of child safety.

When 30 Attorneys General sued Meta in late 2023, most coverage focused on the dollar amount, a potential trillion‑dollar liability, and the emotional testimony about youth mental health. What didn’t get nearly enough attention was the list of structural changes the states are asking a federal court to impose on Instagram and Facebook.

What the 30‑State Lawsuit Against Meta Really Means for Online Safety

Every conversation about app‑store age verification focuses on the front‑end experience: a pop‑up, a prompt, a consent screen. But the real action is happening underneath those screens, in the identity systems required to make “parental approval” work.

What App‑Store Age Checks Really Build: A Family Identity Map

New Research Challenges the Push for Tech Mandates

For years, “school safety” has been used as the political and marketing language to justify new layers of technology inside K‑12 campuses. But a new wave of products, like Verkada’s visitor management and access control system, reveals something much bigger happening beneath the surface.

When the U.S. Court of Appeals for the Fifth Circuit issued its stay order on June 4, proponents of the App Store Accountability Act called it a major victory. This was an early victory lap for a case where the constitutional questions are far from resolved. The stay was a preliminary signal, not a final ruling. The fight was far from over.

Bills requiring identity verification don't just affect minors, they surveil every American. The data infrastructure these bills create serves platforms and government agencies far more than it serves families.

Parents and legislators keep hearing the same reassurance: age verification technology can confirm someone is over 18 without ever revealing who they are. Age, not identity. That's the pitch behind nearly every state and federal age-verification proposal moving through statehouses right now.
